She was a vibrant young mother who went to a Brooklyn hospital for what she thought was a kidney stone. She wound up leaving without her hands and feet because of what her lawyers call a "medical mistake." Now, Tabitha Mullings is suing for $100 million.

The AMA ADMITS to up to 100,000 preventable deaths per year from medical mistakes.

I figgure that the real number is probably tripple that.

Well its all a matter of numbers. There are more people that die from lack of medical care than mistakes in medical care.

Actually this case was more a matter of neglect than mistake. They didn't give her a blood test.

The article is self-contradictory. It says she was "a vibrant young mother" and then says she had a "condition with a propensity for infection." This will be a helluva interesting medical malpractice case. Both sides will have some strong ammo.

This story reminds me of when I was in the VA hospital and this guy was on crutches, it was summer and he was wearing shorts. One leg had all these red and black dotted lines drawn on it and the other had all these notices written on it saying "GOOD LEG" over and over. He told me this is what they do now because of times when the surgeons amputated the wrong leg. The next time I saw him only the good leg was still there.

No the procedure has a propensity for infection Grumpy, not that she had a condition that did. Infections in hospitals are entirely too common and if they did nothing to check for it then they are at fault.

Hell I got an infection from an injection of contrast for an MRI. I didn't loose the hand but I could have had it not been caught in time. I lost two weeks worth of work before the infection went down enough. I also had to pay for a second Dr. Visit at a real doctor to get treatment for the infection and some crazy expensive antibiotics. Then the $1900 bill for the MRI came in and I about flipped out. I called them and told them that as soon as they deducted lost wages, a medical apointment and medication from the bill I would be glad to pay. They said those were not their responsibility. I said yes they are, did the math sent them a check for the balance owed and a note informing them of their liability in the situation, also informing them that if they attempted to collect the ballance or place a deliquent debt on my credit report they would be hearing from a lawyer.

Was 6 months ago and have not heard from them but I am keeping an eye on my credit report.

I gotta hand it to you.. you have sole. I mean, I hate to be a heel, but I can't give you a thumbs up on this one.

On a more serious note this is a tragic case of an avoidable circumstance. Seems as though matter what precautions exist, there are always cases which defy logic. I trust she'll be compensated for her loss - though how do you price your hands and feet? (no joke)

is what it is, it is easy to miss, until it's too late. Saw a bad case in nursing school. This guy went bad during surgery and they still couldn't save major parts of him.

I thought about the way you are interpreting what little we know, coming only from the article. It seems to me they are not saying that the abdominal pain or the kidney stone were worrisome for infection, but that she had a "condition" (like a pre-existing condition) causing her to have a propensity for infection. This sounds like some kind of idiopathic autoimmune disorder, or she has had MRSA and it keeps recurring.

I used to transcribe for these fiendishly intelligent mofo's that were medical doctors who were also at the same time lawyers and they worked for this malpractice insurance company defending against malpractice suits. Damn that shit was interesting.

Grumpy I see what your saying, not sure like you said it is hard to tell from the article. Either way though if they knew she had a propensity to infection or if the procedure had a propensity for infection then they should have been looking for it.

Yes Grumpy, there are also the doctors and nurses who become trial lawyers.

The teams will line up on both sides, and this will be worked out down to the point where neither side can afford to refuse, at which point a settlement takes place.
