A federal judge on Monday ruled against the Bush administration in a court battle over the White House's problem-plagued email system. U.S. District Judge Henry Kennedy said two private groups may pursue their case as they press the administration to recover millions of possibly missing electronic messages.

And they'll continue to act so, continually stalling and stonewalling attempts to enforce the court's ruling. Then, come January 20, they'll leave, having left the court's decision unfulfilled and no one will have the balls to hold it to them.

I'm not holding my breath in anticipation of anything being done to Bush, Cheney ect by anyone when they leave office.

The remedy for illegal activity by the Executive Branch is impeachment. I think, in the end, this other stuff will go no where and if it made it to the SC they will throw it out. I don't think that it would be an ideological decision either. The Constitution clearly spells out what needs to be done if the President has broken the law. That would trump a Federal Judge, IMHO.

Hagbard: Emails typically go through more than one server; if someone looks hard enough (and possibly does some forensic data recovery), it's possible that the emails could be recovered. It's also possible that all servers involved could be scrubbed, but that would have taken a pretty sophisticated effort, done by people who knew exactly what they were doing. That mighta happened, might notta happened.
