The article said the circumcision was performed due to a medical problem he was having.
When they performed the circumcision the physicians then found cancer and removed his entire penis.

He and his wife said the physicians doing the circumcision should have waited and first advised the patient of having found cancer in his penis before just going ahead and amputating it. Probably the patient and his wife wanted to see if there might have been other options for curing his cancer medically available to him -- like radiation or chemo -- before taking the radical step of amputation. He was not given the chance to seek a second opinion on his medical condition.

Surgeons could probably reattach it but who knows if he could ever get an erection again.

I don't know, but I would think if important nerves had been severed or scar tissue formed due to the amputation and the scar tissue obstructed the blood supply to his penis, then he might never be able to get an erection and all his penis would be able to do is just hang there. Also, there might be severe irreparable urology problems since he may now have to wear a catheter due the amputation.

I do believe in malpractice reform but this is why I have strong issues in arbitrary caps for non-economic losses.

This guy has his penis amputated w/out consent but it results in $0 of economic losses as he can still work. Can an arbitrary cap of $250,000 really make up for something like this in anyway (I think that's what Texas was considering a few years back)? Legal fees could easily eat up half of that.

What if the patient was a 20 year old? Yes, he could work and wouldn't be out any economic losses but his life would be drastically altered.

Yeah, this man's loss has been on everyone's lips here in Louisville.

It sure took some balls to do what this doc did without asking first. I'm sure it wasn't hard to find a law firm to stick it to the medical team. While Mr. Seaton wanted to do his own probe into the matter, he wasn't equipped to do much poking around solo, so he went with the firm. That doctor had better prepare for a stiff penilety.

Usually, the statute of limitations gives the plaintiff a year within which to sue. Lawyers like to wait till the end of that year to make sure they have every possible piece of evidence/info before they file.

Perhaps training was the fault. Make sure that the doctor knows which end to cut off. Makes one hell of a difference!
