For those of you that can't seem to read the article:

"McCain spokesman Brian Rogers claims the advert was not a product of the Republican presidential candidate's campaign...But Browne's action contends that the Ohio Republican party released the advert on behalf of McCain and the Republican National Committee."

To use a song in a commercial you have to obtain two separate licenses:

A "SYNC" license to use the "MASTER RECORDING' of the song

A "SYNC" license from the music publisher to use the song itself.

You have to pay a negotiated fee in both cases - usually they end up being the same amount.

McCain's ad guys didn't bother getting either one, thus the problem for them.

McCain's ad guys (who do the ad buys) should have checked to ensure licenses had been granted.

To fail to do so is a reckless move in that world

I think politicians should choose music from musicians that share their views. That would probably limit Republican choices but that's life.
I think it would be an interesting contrast between the parties.

Any artist/record label who discover their songs and/or recordings of songs used in TV commercials have every right to sue. There are clear laws and protocol that must be followed. Whoever put together this McCain spot knew that very well. As regional as the use for the spot was it wouldn't have been an astronomical fee. No excuse. Everyone in the biz knows the rules. They tried circumventing them and got caught. Case closed.

Thought I'd explain the difference in the Chrissie Hynde/Rush situation:

Radio play works differently. If the song has been released to radio, as hers was, anyone can play the song. But, it is the responsibility of Rush's producers to make sure it's logged so royalties can be paid, as OohRah talked about earlier.

Browne's a 'loser' with a 600 acre ranch in Santa Barbara. A 'loser' who owns the copyright on the song in question. A 'loser' who still makes $2 million a year in royalties without lifting a finger. The song for which a simple couple of licenses attained by McCain's ad buyers would have averted this.

I'm in the biz. One friend of mine had 4 pop hits and made over $50,000,000 in 4 years between touring, merchandising, and performance royalties.

Arena tours and all the merchandising (T-shirts, etc) are cash cows. Royalties from radio and TV performances can easily total multimillions for a hit.

Browne's continued touring - making in excess of $100,000 a night 20 years after his last hit. Additionally, 'Running On Empty' has been used in multiple TV commercial campaigns over the years, each campaign netting millions.

I'm giving you an educated opinion.
