Former secretaries of state Warren Christopher and James Baker have declared the War Powers Resolution of 1973 obsolete, proposing new system of closer consultation between the White House and Congress before American forces go into battle. "The 1973 statute has been regularly ignored -- a situation that undermines the rule of law, the centerpiece of American democracy," they wrote in today's New York Times.

The War Powers Act seemed like a good idea when it was passed the 1st time, but it apparently has no teeth, and Dick Shady was a long time opponent, going back to his Congress days.

Perhaps the Baker/Christopher idea will work better, but it doesn't seem so cut and dried on the surface. Have to dig for the fine print. No sense replacing a weak limitation with a useless one.

Why don't they go all the way and delcare the Nuremburgh trials irrelevant too. F$ck it! Just say that corporate america has the right to do whatever it wants, to whomever it wants, for any reason...

Warren Christopher and James Baker were ones who 'almost made it big', but couldn't carry it off. Whatever they say is, for a lack of a better word, irrelevant.

Congress will try to pass something and the next president will Veto it cause it treds on Executive Powers (Constitutional separation of powers - Executive - Legislative - and Judicial), or sign a watered down version. Pretty much, nothing will change because we won't press for it.

A repeal of this stupid, post-Vietnam, anti-Nixon law is a good idea. It's the sort of thing we expect from prissy, self-righteous Democrats when they occassionally ascend to power. Which is why it's an issue today.

The authority to wage war needs to be clarrified, but that won't happen so long as Dems can grandstand like they are now doing.

How about article 1 section 8 of the US Constitution. Section 8. The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;

To declare war, grant letters of marque and reprisal, and make rules concerning captures on land and water;

No President has the Constitutional power to take us to war. If these guys would just spend a few minutes and read the dam thing we would be better off.

Like most cons.... no he doesn't tire of being wrong. It is almost second nature to them.

Now? Now, they want to strip future Presidents of powers? After eight years of consolidating executive power?

Why because it looks like a Democrat might win?

These two apologists for BIG MONEY are making a move, under a bi-partisan smokescreen.

Baker was in charge of stopping the Florida recount. Christopher represented the Democrats in that dispute running around telling everyone to be careful not to incite a riot. Baker of course was not bound by such a rule and sent a planeload of demonstrators into the Dade County Offices bringing that recount to an immediate halt.

Baker is also chief counsel for the Carlyle Group and the Nation of Saudi Arabia, with his own office in the White House. He has also led the charge on debt forgiveness for Iraq, while inserting a special exception for Kuwait. As counsel for Saudi Arabia, he stopped a 9-11 victims lawsuit brought by surviving relatives, that sought compensation for the Saudis role in financing that attack.

Christopher led negotiations between the Clinton Administration and North Korea which led to a proposed Treaty condemned by #43. Rumsfeld profited directly from those negotiations in the business dealing which followed. But Shrub recently and inexplicably forgave the North Koreans for detonating a Nuclear Bomb, in violation of that treaty which Shrub never recognized.

Shrub has shown no respect for the rule of law, ignoring international treaties such as the Geneva Conventions, Kyoto and the Nuclear Non-Proliferation treaty signed by Iran, the rules of the FISA Court, and generating endless signing statements in direct contradiction of the Bills he simultaneously signed. Bush has also violated the 1973 War Powers Act.

Clinton is the only civil servant in the history of the United States to have to defend against a civil lawsuit, while serving in office. A partisan attack fully supported in Clintons case by SCOTUS, but forbidden where Bush is concerned. Bushs exposure to lawsuits after he leaves office is substantial. This move is clearly designed to retroactively protect Bush and his cronies from lawsuits after they leave office. Christopher is being used to lend a bi-partisan-- flavor to the joke.

Our Constitution explicitly forbids retroactive legislation. Like the bill pending in Congress to retroactively immunize the Telecom Companies from lawsuits, following the law and our Constitution is only a requirement for little people. With enough money and power you can do whatever the fuck you want, because our Government is corrupt.

The question is: whose interests do these two crooks represent--? and do we live in a Democracy--?
