Today's New York Times covers the DMCA copyright takedowns filed by The Associated Press against Drudge Retort bloggers. The AP said that it will, for the first time, attempt to define clear standards as to how much of its articles and broadcasts bloggers and Web sites can excerpt without infringing on The AP's copyright. AP Files 7 DMCA Takedowns Against Drudge Retort
The Associated Press claims that Drudge Retort users linking to its stories are violating its copyright and committing "'hot news' misappropriation under New York state law." An AP attorney filed six Digital Millenium Copyright Act takedown requests this week demanding the removal of blog entries and another for a user comment.

It was kind of easy to see this coming as I would assume the AP actually sat down and thought about the consequences that could flow from their bully tactics.

I say the more credit given, the better.

Naming the reporter along with the media organization also serves another purpose: Reporters, like everybody else, google their names to see what's being said about them. If we give a reporter's linked story a thorough working-over on the Retort, it would be nice if the person saw the comments.

I'm glad AP is going to give guidelines. I looked at a lot of stories yesterday and they are either AP or else are locally written but in a media source which is connected back to AP via agreements.

I'm curious. How much $$$$$ does it cost for a media outlet (local paper, blog, whatever) to join the AP's little club and get their permission to use their stories? This stinks of of a monopoly.

AP got its knickers all in a twist over a user submitted story in Drudge Retort, linking to and quoting some 50 words (32 being a Hilary Clinton quote) from the news agency, in what most would assume is "fair use". Most, except AP of course, who doesn't want anyone touching its precious quotes. Hands off!

I had one of the 7 stories yanked down. Guess I'll save your email where you told me about it, Rcade, now that you're going to be famous. (grin) This little tiff with AP could end up setting some sort of legal precedent -- at least in copyright law. Interesting and fun -- as long as it doesn't cost any money in legal fees. I think the owners of all the blogs and websites who would be affected by AP's monopoly should bring a class action suit against AP. AP is literally trying to OWN all the news.

What I don't still can't understand is how AP can claim their ownership of a quote given by anyone else. If the quote is just put out there how can AP claim ownership unless it was in the context of a specific one-on-one interview with an AP reporter. AP is way overstepping its boundaries in alledging copywrite ownership. imho.

AP will eat this for awhile longer as Roger gets his 5 minutes more in Wikipedia in AP's entry therein soon enough:>)

I would assume there are exclusivity agreements when conducting an interview with someone. If the quote was from a public appearance by whoever then I would agree with you.

IMO this ranks 2nd to rCade's televised interview (in which he looks like an ex-con with a bad shave) with Katie Colic on the Pope domain. She was all a twit-ter when he demanded a miter in exchange for the url. Of course he left out the part about wanting to wear it in the annual Gay Pride Parade. Discretion being the better part of something or other.

Why worry about what AP thinks about anything? There are many other national and international news agencies that would love to be cited.

I think RCADE would look more distinguished if He got rid of those 1950's style of glasses for a more modern look but that's just Me. He would look more sophisticated and less Nerdy.

I understand why the AP doesn't want large excerpts of their articles quoted in blogs, but allowing bloggers to quote short excerpts actually draws people, who want to read the whole article, to their website. Setting up some kind of standards will be good. I just hope they aren't wordwise and article foolish. 39 to 79 words doesn't sound outrageous, especially when a link to the original article is provided.

I don't understand why they picked this site to sanction. Of all the blog joints in the world, they walked into this one? Maybe they didn't like folks like Murphy and Johnson claiming the AP was in the tank for Obama. ;-)

What publicity. It's surprising that particpation on this blog has not peaked as a consequence. How can this "blip" be exploited.

Think of the notoriety. Of all of the blogs on all of the ... the Drudge Retort was chosen.

The length of the quotes seems to render them insignificant within the concept of fair use, especially compared to the verbatim texts of articles that have been posted. Was there any unifying factor to the items cited by AP?

Exploiting the opportunity to publicize the blog would seem to merit focus.
