It was only months later that the IRS and the FBI determined that Spitzer wasn't hiding bribes but payments to a company called QAT, what prosecutors say is a prostitution operation operating under the name of the Emperors Club. ...

The suspicious financial activity was initially reported by a bank to the IRS which, under direction from the Justice Department, brought in the FBI's Public Corruption Squad. "We had no interest at all in the prostitution ring until the thing with Spitzer led us to learn about it," said one Justice Department official."

Well, there is at least some confusion as to how this investigation came about, and the author of the article is quite familiar with political prosecutions.

If any of us make a deposit of $10,000 it gets reported as a suspicious activity. Usually its nothing but sometimes things get uncovered. We have to send the reports of suspicious activity, potential money laundering, at my place of business all the time.
He got investigated becasue of who he is. A gov moving around that kind of money could be bad. Thankfully he was only hiding money from his wife and not something worse. The Gov wasnt looking for a sex scandel (at least I hope not). The sex isnt really the issue. Who cares he if like the strange, thats not the point. The bigger issue is support of illegal activity that is "usually" connected to organized crime. His activity could lead to puttin himself and his position into a compromised position. Blackmale? MARCH 10--With the bombshell news today that New York Governor Eliot Spitzer has been implicated in a prostitution ring, the Democratic politician will now always be known as "Client-9," one of the johns described in a recently unsealed FBI affidavit detailing the operation of the Emperors Club, an international call girl ring. That document, an excerpt of which you'll find below, describes hooker interactions with 10 johns, including one client who paid cash for a February 13 rendezvous at a Washington, D.C. hotel. The New York Times, which broke the Spitzer story, has identified the 48-year-old politician as Client-9. As described in the FBI document, Client-9 (clearly a repeat customer) apparently went to great lengths to arrange the illicit Washington encounter, choosing to mail money in advance to the ring, instead of using a credit card. Client-9, whose conversations were recorded by an FBI wiretap, would not do "traditional wire transferring," the affidavit quotes one Emperors Club employee remarking. Additionally, the affidavit notes that after her appointment with Client-9 ended, "Kristen" spoke with a Emperors Club booker, who said that she had been told that Client-9 "would ask you to do things that, like, you might not think were safe..." Spitzer lived in a glass house and was throwing stones at a prodigious rate. Spud did rather question the underlying motivations behind the wiretaps and intimated that perhaps the investigation was blowback from his prosecutions of Wall Street and the Mob, which some have suggested were a little overzealous.

Bottom line is, ultimately his dick set him up and his balls were accomplices.

He fucked this chick on the day before Valentine's Day. He made that call. Even if it was payback his culpability is not deniable.

Maybe because the Dems are worse at covering up their corruption then the Reps? Or that they are easier to convict? These reasons are just as valid as some massive GOP lead conspiracy to turn Justice into its very own Star Chamber.

People tend to forget that Justice is a massive bureaucracy, and tends to move on its own inertia, regardless of who is in the WH. That's not to say that the senior AUSA's aren't pressured by the appointed USA's to do things their way, but anyone who has spent time working for the US Gov't knows that the rank and file bureaucrats don't pay too much attention to the political machinations going on above their pay grade. In fact, most of the AUSA's are more concerned about their conviction ratio, since that is what will get them the plum white collar gig with an AmLaw 100 firm upon leaving Justice.

Senator Hillary Rodham Clinton (D-NY): In addition to her long and sordid ethics record, Senator Hillary Clinton took a lot of heat in 2007 and rightly so for blocking the release her official White House records. Many suspect these records contain a treasure trove of information related to her role in a number of serious Clinton-era scandals. Moreover, in March 2007, Judicial Watch filed an ethics complaint against Senator Clinton for filing false financial disclosure forms with the U.S. Senate (again). And Hillary's top campaign contributor, Norman Hsu, was exposed as a felon and a fugitive from justice in 2007. Hsu pleaded guilt to one count of grand theft for defrauding investors as part of a multi-million dollar Ponzi scheme.

2. Rep. John Conyers (D-MI): Conyers reportedly repeatedly violated the law and House ethics rules, forcing his staff to serve as his personal servants, babysitters, valets and campaign workers while on the government payroll. While the House Ethics Committee investigated these allegations in 2006, and substantiated a number of the accusations against Conyers, the committee blamed the staff and required additional administrative record-keeping and employee training. Judicial Watch obtained documentation in 2007 from a former Conyers staffer that sheds new light on the activities and conduct on the part of the Michigan congressman, which appear to be at a minimum inappropriate and likely unlawful. Judicial Watch called on the Attorney General in 2007 to investigate the matter.

3. Senator Larry Craig (R-ID): In one of the most shocking scandals of 2007, Senator Craig was caught by police attempting to solicit sex in a Minneapolis International Airport men's bathroom during the summer. Senator Craig reportedly "sent signals" to a police officer in an adjacent stall that he wanted to engage in sexual activity. When the police officer showed Craig his police identification under the bathroom stall divider and pointed toward the exit, the senator reportedly exclaimed 'No!'" When asked to produce identification, Craig presented police his U.S. Senate business card and said, "What do you think of that?" The power play didn't work. Craig was arrested, charged and entered a guilty plea. Despite enormous pressure from his Republican colleagues to resign from the Senate, Craig refused.

Senator Diane Feinstein (D-CA): As a member of the Senate Appropriations Committee's subcommittee on military construction, Feinstein reviewed military construction government contracts, some of which were ultimately awarded to URS Corporation and Perini, companies then owned by Feinstein's husband, Richard Blum. While the Pentagon ultimately awards military contracts, there is a reason for the review process. The Senate's subcommittee on Military Construction's approval carries weight. Sen. Feinstein, therefore, likely had influence over the decision making process. Senator Feinstein also attempted to undermine ethics reform in 2007, arguing in favor of a perk that allows members of Congress to book multiple airline flights and then cancel them without financial penalty. Judicial Watch's investigation into this matter is ongoing.

Former New York Mayor Rudy Giuliani (R-NY): Giuliani came under fire in late 2007 after it was discovered the former New York mayor's office "billed obscure city agencies for tens of thousands of dollars in security expenses amassed during the time when he was beginning an extramarital relationship with future wife Judith Nathan in the Hamptons ... " ABC News also reported that Giuliani provided Nathan with a police vehicle and a city driver at taxpayer expense. All of this news came on the heels of the federal indictment on corruption charges of Giuliani's former Police Chief and business partner Bernard Kerik, who pleaded guilty in 2006 to accepting a $165,000 bribe in the form of renovations to his Bronx apartment from a construction company attempting to land city contracts.

6. Governor Mike Huckabee (R-AR): Governor Huckabee enjoyed a meteoric rise in the polls in December 2007, which prompted a more thorough review of his ethics record. According to The Associated Press: "[Huckabee's] career has also been colored by 14 ethics complaints and a volley of questions about his integrity, ranging from his management of campaign cash to his use of a nonprofit organization to subsidize his income to his destruction of state computer files on his way out of the governor's office." And what was Governor Huckabee's response to these ethics allegations? Rather than cooperating with investigators, Huckabee sued the state ethics commission twice and attempted to shut the ethics process down.

7. I. Lewis "Scooter" Libby: Libby, former Chief of Staff to Vice President Dick Cheney, was sentenced to 30 months in prison and fined $250,000 for lying and obstructing the Valerie Plame CIA leak investigation. Libby was found guilty of four felonies -- two counts of perjury, one count of making false statements to the FBI and one count of obstructing justice all serious crimes. Unfortunately, Libby was largely let off the hook. In an appalling lack of judgment, President Bush issued "Executive Clemency" to Libby and commuted the sentence.

8. Senator Barack Obama (D-IL): A "Dishonorable Mention" last year, Senator Obama moves onto the "ten most wanted" list in 2007. In 2006, it was discovered that Obama was involved in a suspicious real estate deal with an indicted political fundraiser, Antoin "Tony" Rezko. In 2007, more reports surfaced of deeper and suspicious business and political connections It was reported that just two months after he joined the Senate, Obama purchased $50,000 worth of stock in speculative companies whose major investors were his biggest campaign contributors. One of the companies was a biotech concern that benefited from legislation Obama pushed just two weeks after the senator purchased $5,000 of the company's shares. Obama was also nabbed conducting campaign business in his Senate office, a violation of federal law.

How much of a hypocrite is he? It's not like he RAN a prostitution ring, after all.

The pet project involved renovating ports in Speaker Pelosi's home base of San Francisco. Pelosi just happens to own apartment buildings near the areas targeted for improvement, and will almost certainly experience a significant boost in property value as a result of Pelosi's earmark. Earlier in the year, Pelosi found herself in hot water for demanding access to a luxury Air Force jet to ferry the Speaker and her entourage back and forth from San Francisco non-stop, in unprecedented request which was wisely rejected by the Pentagon. And under Pelosi's leadership, the House ethics process remains essentially shut down which protects members in both parties from accountability.

Senator Harry Reid (D-NV): Over the last few years, Reid has been embroiled in a series of scandals that cast serious doubt on his credibility as a self-professed champion of government ethics, and 2007 was no different. According to The Los Angeles Times, over the last four years, Reid has used his influence in Washington to help a developer, Havey Whittemore, clear obstacles for a profitable real estate deal. As the project advanced, the Times reported, "Reid received tens of thousands of dollars in campaign contributions from Whittemore." Whittemore also hired one of Reid's sons (Leif) as his personal lawyer and then promptly handed the junior Reid the responsibility of negotiating the real estate deal with federal officials. Leif Reid even called his father's office to talk about how to obtain the proper EPA permits, a clear conflict of interest.

Look, if you're married you shouldn't engage hookers for sex. That being said, I think we all can agree that the so-called rich and powerful live by different rules than 96% of us shlubs. Spitzer was not set up. He was outed. Set up would imply that he didn't know what he was doing, and unfortunately it seems he knew only too well.

The premise that Spitzer was set up is a little shaky. He didn't trip and fall into a $5,000 hooker accidentally. But the history of politician prosecutions under Bush's DOJ deserves scrutiny, especially with the travesty in Alabama. We can't allow partisans to prosecute the other side to gain electoral adbantage.

because of Spitzer banks run software that examine all transactions, he being a person of power is labeled a PEP in that software, Politically Exposed Person. So since he was a PEP, his transactions were scrutinized by the software more closely.

it wasn't the fact that he transfered 5k, it was how many times and in what time intervals he transfered 5k.

I heard on Air America that DOJ's Mukase gave permission to start wire tapping Spitzer last January, but I could find nothing to substantiate that through Google. Can anyone here provide a link or any kind of confirmation?

If you look at the long list of cases in which accusations of highly irregular financial conduct were lodged against Republican elected officials, you will discover that in each case the Bush Justice Department reacted by doing nothing. No review of payments and bank records. No questions. No investigators. No warrants for wiretaps. In each case, Bush's "Justice" Department concluded that there was insufficient grounds to launch an investigation. And in two of these cases there were extremely specific, well documented allegations -- not something as nebulous as a Suspicious Activity Report (which led to Spitzer's downfall).

Also significant: The case against Spitzer did not start with the report of a crime. Rather it probably started with a decision to look into Spitzer's financial dealings to see if any dirt could be spotted and then developed into something consequential. It was not the amount of money being transferred that triggered interest. What triggered not just interest but action was the person initiating the transfers, for he was a powerful Democratic governor who just might be, by this means, removed from office.

Several reports about this case have suggested that it is somehow routine for prosecutors to go through the financial records of public officials to look for evidence of corruption. But in the absence of specific grounds justifying the investigation (for instance, an informant complaining about a bribe), prosecutors have no such authority. Investigators in this case appear to have been investigating Spitzer in the hopes of finding something compromising. Nailing Spitzer had become a politically-based priority.

By contrast, in the case of Republican Congressman David Vitter, federal prosecutors had proceeded against a prostitution ring yet showed little interest in the customer list that included a former high-ranking Bush Administration official (Randall Tobias, director of the U.S. Agency for International Development) and a U.S. Senator (David Vitter, Republican of Louisiana). In fact, the prosecutors' conduct in the "D.C. Madam" case was remarkably deferential to the public figures involved. Vitter got a slap on the wrist and that was the end of it. So why the double standard when it's a Democrat that gets caught in the net?

The feds had built their case against the prostitution ring and were ready to make arrests, but it seems they held back in hopes they could get enough incriminating evidence to maximally slam Spitzer. They could have gone with the announcement about the prostitution ring back in January. But they didn't. They waited until they could get permission from Attorney General Mukase to tap Spitzer's phone calls they got that permission that same month, January, and then proceeded to get enough on Spitzer to end his service as governor.

Once the IRS discovered it had caught the New York governor in its web, it forwarded the case to the US Attorney General's Office, where it was pursued by the FBI, apparently on the instructions of AG Michael Mukasey.

The investigation moved from monitoring the bank to monitoring phones, and Spitzer was captured talking to the Emperor's Club dispatcher. Bingo. Promising Democratic political career ruined."

For all of Spitzer's hubris, this case provides a strong indication that Bush isn't trying to catch "terrorists" for one minute. What his White House is doing is compiling information and dirt that they can use to intimidate anyone who would challenge them. And they're devoting millions of dollars of willing and gullible taxpayers to carry off this grand larceny.
