The retention of Presidential records is mandated by law. Bush, Cheney, Rove, Meiers and Gonzales all KNEW this to be the case. The "recycling" of backup tapes is criminal unless the information on said tapes is stored in some other form somewhere else. As far as this being and "industry standard", I call bullshit. I've designed and managed the implementation of dozens of Enterprise Backup Solutions. One of the key components of the design is always related to Compliance Standards. Depending on the industry and by whom they're regulated data retention is ALWAYS a minimum of 7 years, much longer for some.

You are exactly right, he wasn't convicted of it, but in fact admitted that he did perjure himself and was punished for it:
