The government objected to that order, and the judge modified it on Nov. 3, 2005, to ask for confirmation of whether the government "has video or audio tapes of these interrogations" and then named specific ones. Eleven days later, the government denied it had video or audio tapes of those specific interrogations.

Last month, the CIA admitted to Brinkema and a circuit judge that it had failed to hand over tapes of enemy combatant witnesses. Those interrogations were not part of the CIA's detention program and were not conducted or recorded by the agency, the agency said.

WASHINGTON - The Senate's No. 2 Democrat on Friday asked the Justice Department to investigate whether the CIA obstructed justice by destroying videotapes that documented the harsh 2002 interrogations of two alleged terrorists.

A day after CIA Director Gen. Michael Hayden told agency employees the tapes were destroyed in 2005, members of Congress, human rights groups and lawyers for accused terrorists said the tapes may have been key evidence that the U.S. government had illegally authorized torture.

In a letter to Attorney General Michael Mukasey, Senate Democratic Whip Dick Durbin of Illinois asked for a probe of "whether CIA officials who destroyed these videotapes and withheld information about their existence from official proceedings violated the law."

In a speech on the Senate floor, Durbin dismissed the CIA's explanation that it was trying to protect the identities of the interrogators.

"We know that it is possible and in fact easy to cover the faces" of those who appear on camera, Durbin said. "This is not an issue that can be ignored."

Senate Intelligence Committee Chairman Sen. Jay Rockefeller, D-W.Va., said his committee would conduct a full review of the matter. Democratic presidential hopeful Sen. Hillary Clinton, D- N.Y., also called for a full investigation.

"We've got to really clean house here and get to the bottom of what's been going on in the last years," she said Friday.

Where was "the case" for which this was to constitute "evidence?"

This was a tape made so that the responses of the terrorist being questioned could be reviewed for nuances in his behavior that might provide leads.

This attempt at transformation of a tool into "evidence" as if there were some pending inquiry, is really a stretch. It possibly illustrates the depths to which our society has degraded itself when all activities need to be recorded so that they provide exculpation from the possibility of charges which carry a presumption of wrongdoing.

There was no need to preserve the tape at the time it was destroyed. It was not "evidence" in any proceeding.

The alacrity with which "pro-terrorist success advocate" renegades and the anti-American press here leap upon this and mischaracterize it, is indicative of the malasie that afflicts this country. These lefties in a decent land would be sent scurrying back to their ratholes.

The CIA must have been worried about felonies committed on the video. Unless they've never heard of pixelizing the faces of the agents (blocking out faces), and the fact the videos would never have gone beyond oversight committees in the House and Senate, it's the only plausible explanation.

It is worth noting that the CIA actually informed members of Congress about the tapes four years ago and also informed them in advance about their intention to ultimately destroy the tapes. One leading Democrat admits he knew about the destruction of the tapes last fall. Via AP:

MSGT - I did find some information on who was briefed. Not the committees, but specifically 2 people in Congress. Both Democrats. The writing assumes 2 Congressional Republicans (not named) were also informed. I have to recant the "only person" statement:

We can go round and about it for ever more with CIA lawyers, law professors, judges, Bush, Republicans and Democrats and whoever. The fact remains for anybody born earlier than yesterday that the tapes were destroyed because they showed that the prisoners were being tortured and that is a war crime and Bush is, as he never tires of telling us, a War President.

They knew it was illegal and this proves it. Destruction of evidence should be treated the same as a signed confession.

So far, no news about the AG issuing an order for all gov't employees to secure and preserve any and all relevant information about this fiasco in their files, just in case investigators might need it for their investigations (presuming there are any investigations).
