A federal grand jury has returned a sealed indictment against former New York Police Commissioner Bernard Kerik, sources familiar with the investigation said Thursday.

In New hampshire, Romney now has support from 32% of Likely Primary Voters. That figure matches his highest level of support of the season and is up from 28% a month ago. While he has struggled in national polls, Romney has consistently remained on top in the early voting states of New Hampshire and Iowa.

Rudy Giuliani attracts 17% of those voters, down a couple of points from the last survey.

John McCain at 16% and Mike Huckabee at 10% are the only other Republicans in double digits.

Fred Thompson now attracts just 7% of the vote and is trailed by Ron Paul (4%)

Another close friend of Mr. Giuliani, Ken Caruso, a partner in the candidate's law firm, Bracewell & Giuliani LLP, is accused in a lawsuit pending in a New York state court of professional misconduct toward a client.

J. Virgil Waggoner, a wealthy Texan who lost $10 million in the 1990s investing with a now-defunct offshore bank that a Senate investigative report identified as fraudulent, described Mr. Caruso in the suit as being in league with the people who defrauded him. Mr. Waggoner accused Mr. Caruso of helping the people who defrauded him escape liability, even as he charged Mr. Waggoner for legal advice that went against his interests. Also named in the suit is the Bracewell & Giuliani law firm, where Mr. Caruso is a partner in the New York office headed by Mr. Giuliani.

Mr. Caruso worked with Mr. Giuliani in the Justice Department in Washington in the 1980s and helped on his campaigns for mayor. Mr. Giuliani appointed him to two New York City commissions.

As New York mayor in the 1990s, Mr. Giuliani weathered other scandals involving people in his political orbit.

Charles Hughes, a major union supporter of Mr. Giuliani, went to prison after pleading guilty in 2000 to stealing $2 million from union members.

Russell Harding, the son of a lobbyist and close political adviser to Mr. Giuliani, went to prison in 2005 for embezzling $400,000 from the New York City Housing Development Corp., where he was president. Mr. Giuliani had appointed him to the post


Rudy Giuliani won't say if he'd pardon Kerik as President

Rudy Giuliani refused to say if he'd consider pardoning his old friend Bernie Kerik - who was indicted Thursday on federal corruption charges - if elected President.

"It wouldn't be fair to ask that question at this point," the Republican presidential hopeful said in an exclusive interview in Dubuque, Iowa, just hours before Kerik was indicted in New York.

"He may or may not be charged, he may or may not be convicted. Who knows what happens?"

As uncomfortable and hypothetical as the question may be, it's one of many tough queries Giuliani will face as his former police commissioner's case winds its way through the courts amid a white-hot presidential race.

The indictments are due to be unsealed today when Kerik - whom Giuliani pushed in 2004 to be U.S. homeland security czar - is expected to be arraigned.

Giuliani has been accused of no wrongdoing, but it's nonetheless the start of a long perp walk for Kerik filled with politically delicate potholes for the GOP front-runner.

Will Giuliani, who has testified once before a separate Kerik grand jury, be dragged off the campaign trail to testify again at Kerik's expected trial?

Can Kerik's lawyers use procedural moves to delay any trial beyond the presidential primaries or, if Giuliani is the GOP nominee, beyond the Nov. 4 election?

And how much will Giuliani's rivals use Kerik's indictment to raise broader questions about the former mayor's judgment?

The legal questions will sort themselves out over time. But the lines of political attack over Kerik were being drawn.

"If Rudy is the nominee," said a Democratic presidential strategist, "[Kerik] will enter into every discussion in the media, in the debates and in voter town halls that focus on national security. I mean, this was his choice to watch over the country's homeland."

A senior official of another Republican campaign predicted that Giuliani's momentum will be blunted seriously in the next week because of the media spotlight on the Kerik case.

"We don't intend to say anything because we won't have to," the official said

Bernard Kerik did an irresponsible job training police in Iraq, presidential contender John McCain said Friday, adding to criticism of Kerik as Rudy Giuliani's former police commissioner surrendered to face charges in New York
"I don't know Mr. Kerik. I do know that I went to Baghdad shortly after the initial victory and met in Baghdad with (Ambassador Paul) Bremer and (Lt. Gen. Ricardo) Sanchez. And Kerik was there. Kerik was supposed to be there to help train the police force. He stayed two months and one day left, just up and left," McCain told reporters traveling on his campaign bus.

"That's why I never would've supported him to be the head of homeland security because of his irresponsible act when he was over in Baghdad to try and help train the police. One of the reasons why we had so much trouble with the initial training of the police was because he came, didn't do anything and then went out to the airport and left."

Republican McCain campaigned on Friday with Tom Ridge, the former governor of Pennsylvania and the nation's first secretary of homeland security under President Bush.

"It was clear the mayor and I had a different view what the department does and the kind of leadership it needed," Ridge told reporters. "His judgment would've been different than mine."

He said the situation reflected a fundamental misunderstanding by Giuliani of how the U.S. government works.

"We're not talking about some urban city patronage job," Ridge told The Associated Press. "That's not what a Cabinet secretary's about."

McCain said Giuliani's overall experience hasn't prepared him for the White House or to direct national security policy.
